Version 1.0-draft · effective 2026-10-06
Terms of Service
These terms govern the use of iCall.tel ("the service"), operated by the iCall.tel operating company ("we", "us"). "Customer" means an organization or application that has an agreement with us to use the service; "you" means anyone who uses it, including a customer's users and guests who join a call from a link.
If a customer has signed a separate agreement with us, that agreement prevails where it differs from these terms.
1. Who may use the service
- The service is for business use. It is offered to the applications, clients and users of the solutions it is integrated with. There is no public sign-up: accounts are created by invitation, by a customer, or through an integrated application.
- You must be 18 or older.
- If you use the service on behalf of an organization, you confirm you are authorised to bind it to these terms.
2. Your account
Keep your credentials and API keys confidential, use two-factor authentication where offered, and tell us promptly at security@icall.tel if you suspect unauthorised use. You are responsible for activity under your account and keys.
3. Acceptable use
You must not use the service to:
- break the law, or infringe anyone's rights;
- record anyone without the notice and consent the law requires — some places require every participant's consent;
- process protected health information (for example, under HIPAA) or other regulated data that requires a specific agreement, unless we have signed that agreement with you;
- offer a service directed at children, or collect information from anyone under 18;
- harass, threaten, defraud, or distribute malware or unlawful content;
- probe, scan, load-test or attack the service, including its relay and signaling, or use them for any traffic other than calls made through the service;
- get around access controls, rate limits or usage limits, or access another customer's data;
- resell or sublicense the service, except as an agreement with us allows.
4. Customers' responsibilities
A customer is responsible for its users' conduct, for the lawfulness of the content its users bring to the service, and — when its users record calls — for giving the notices and obtaining the consents the law requires. A customer acts as the controller of its organization's calls, meetings and recordings; our Data Processing Addendum applies to that processing and forms part of these terms.
5. The API
Use of the API requires a key issued to you. Keep it secret, use it only from your own systems, and stay within the documented rate limits. We may change the API with reasonable notice, and may suspend a key that is leaked or abused. The integration guide and the published specification describe current behaviour.
6. Your content
You, or the customer you use the service for, keep all rights in your content: meeting details, chat messages and recordings. You give us only the permission needed to host, transmit and process it to provide the service. We do not use your content for any other purpose, and we do not use it to train any model.
7. Our property
The service, its software and its documentation are ours or our licensors'. Open-source components are used under their own licences. Except for the right to use the service under these terms, no rights are granted.
8. Availability and changes
The service is under active development. We work to keep it available and secure, but we do not guarantee that it will be uninterrupted or error-free, and we may change or discontinue features. We will give customers reasonable notice of changes that materially reduce the service.
9. Suspension and termination
We may suspend access that breaks these terms, threatens the security of the service or of others, or is required by law; where reasonable we tell you first. A customer may stop using the service at any time. When a customer's agreement ends, we make its data available for export on request for 30 days and then delete it, except where the law requires us to keep it.
10. Disclaimer
To the extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability under these terms is limited to the amounts paid to us for the service in the twelve months before the claim, or USD 100 if none were paid. Nothing here limits liability that cannot be limited by law.
12. Indemnity
A customer will defend and indemnify us against third-party claims arising from its or its users' content, its users' breach of these terms, or recordings made without a required notice or consent.
13. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The courts located there have exclusive jurisdiction, except that either party may seek urgent injunctive relief anywhere.
14. Changes to these terms
We publish every change here with a new version and date. Material changes take effect 30 days after notice to customers, unless they are required by law sooner.
